Agreement

These Terms govern your use of On This Day, an iPhone app by Tiny Whale. By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

App License

Tiny Whale grants you a personal, limited, non-exclusive, non-transferable license to use On This Day on Apple-branded devices you own or control, subject to these Terms and Apple's App Store terms.

You may not copy, resell, redistribute, reverse engineer, or modify the app except where applicable law allows it.

Your Photos Library

On This Day uses access you grant through iOS to browse photos and videos by date. You are responsible for the photos and videos in your library and for actions you take in the app, including sharing, saving, editing, favoriting, or deleting items where those actions are available.

Tiny Whale is not responsible for loss of photos, videos, metadata, edits, or organization resulting from device problems, iCloud Photos behavior, user actions, or third-party services.

Paid Features and Subscriptions

If On This Day offers paid features, purchases, or subscriptions, they are sold through Apple's App Store. Billing, renewal, cancellation, refunds, taxes, and payment methods are handled by Apple under Apple's terms.

Subscriptions, if offered, may renew automatically unless cancelled through your App Store account settings before renewal. Tiny Whale may change, add, or remove paid features where permitted by law and App Store rules.

Acceptable Use

You may not use On This Day to violate the law, infringe someone else's rights, bypass Apple platform restrictions, interfere with the app's operation, or attempt unauthorized access to systems or data.

Ownership

On This Day, including its design, code, branding, and related materials, belongs to Tiny Whale or its licensors. These Terms do not transfer any ownership rights to you.

Your photos and videos remain yours. Tiny Whale does not claim ownership of your Photos library.

Privacy

Your use of the app is also governed by the Privacy Policy, which explains how On This Day handles Photos access, support messages, purchases, diagnostics, and local app data.

Third-Party Services

The app depends on Apple services and frameworks, including iOS, Photos, iCloud Photos, StoreKit, and the App Store. Tiny Whale does not control those services and is not responsible for their availability, behavior, or terms.

Changes and Availability

Tiny Whale may update, change, suspend, or discontinue any part of On This Day. We try to keep the app reliable, but we do not guarantee that it will always be available, error-free, or compatible with every device, library size, iOS version, or Photos configuration.

Disclaimer

On This Day is provided "as is" and "as available" to the fullest extent permitted by law. Tiny Whale disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Limitation of Liability

To the fullest extent permitted by law, Tiny Whale will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business opportunities arising from your use of the app.

Termination

You may stop using On This Day at any time. Tiny Whale may suspend or terminate access to the app if you violate these Terms or if continued access would create legal, security, or operational risk.
